SIPO Passed New Patent Examination Guidelines

The State Intellectual Property Office (SIPO) has promulgated the amended Guidelines for Patent Examination which will come into force on May 1, 2014, according to the Ordinance of the State Intellectual Property Office NO. 68.

 

The changes are made regarding the patent of graphical user interface (GUI) design which will be accepted and protected under the amended guidelines. Amendments included:

 

The applicant shall submit the design of the whole product when applying. If the GUI is a dynamic pattern, the applicant shall provide at least the view of the product in one mode. Other modes can be submitted with key frames. The submitted views shall be the only ones to determine the trend of the changing animation in the dynamic design.

 

GUI design applications are to specify, when necessary, the usage, the area of GUI in the product, the human-machine interaction method, the changing mode, etc.
