The new Chinese Trademark Law makes several substantial changes regarding trademark infringement, including likelihood of confusion as an element in determination of trademark infringement when concerned with similar marks and similar goods/services, a jump in the amount of statutory damages, punitive compensation, and lessening trademark owner’s burden of proof. The roundtable discussion with professionals and practitioners aims to bring in a comprehensive understanding regarding those new changes.
