A registered mark would be subject to non-use cancellation if the trademark owner cannot prove the registered mark is used for the registered goods and/or services at the material time. This roundtable provides an opportunity for legal practitioners and brand owners through a series of questions and answers to discuss:
- Different standards for the establishment of “use” of mark within the meaning of Hong Kong and EU legislation; and
- How to effectively defend non-use trademark cancellation action in Hong Kong and the EU.
